THESE TERMS OF USE ARE FOR AN INDIVIDUAL AND/OR COMPANY'S USAGE AND PARTICIPATING IN EZY webhosting AFFILIATE PROGRAM. BY ACTIVATING OUR AFFILIATE PROGRAM, YOU AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS SET FORTH IN THIS AGREEMENT RELATIVE TO YOUR PARTICIPATION IN THE AFFILIATE PROGRAM. WE RESERVE THE RIGHT TO EDIT, CHANGE, AND REVISE THESE TERMS ANY TIME. BY PARTICIPATING YOU AGREE TO THE FOLLOWING TERMS:

1. JOINING THE PROGRAM. By requesting an affiliate status you will become an Ezywebhosting affiliate. Your membership in the program is solely for this purpose: to legally advertise the Ezywebhosting site and products and receive a commission on sales generated by your referrals.

2. AFFILIATE COMMISSIONS. Affiliate commissions will be paid out via PayPal or Direct Deposit with a minimum required commission value of $60.00AUD for payment. If the referred product was refunded, membership cancelled, or money was reimbursed, Ezywebhosting will deduct the appropriate commissions from the affiliate's account.

3. AFFILIATE TRACKING. After signing up for the program you will receive an affiliate url which you will use to advertise our website. When someone clicks through this url, a cookie will be set in their browser with your affiliate ID and will be logged. During that visit to our website or any later visit, when a purchase is made the commission will be given based on the existence of the cookie in the database.

4. LINKING TO Ezywebhosting. Ezywebhosting makes available to our Affiliates, links, banners, and other information advertising our site to be used subject to the terms of this Agreement. You may use the graphics and text provided to you by Ezywebhosting, You will not modify the links or other materials that we provide you. You may create your own as long as they are deemed appropriate according to the conditions in section 5.

5. REVOCATION OF AFFILIATE STATUS. Your affiliate application and status in the program may be suspended or terminated for any of the following reasons: Inappropriate advertisements (False claims, misleading hyperlinks), Spamming (mass email, mass newsgroup posting, etc.), Advertising on sites containing/promoting illegal activities, Violation of intellectual property rights (copying Ezywebhosting's material), or for no reason at all. You will forfeit all rights to receive past commissions that may have accrued to you if this Agreement is terminated as a result of your failure to comply with the terms of this Agreement or any policies and procedures of Affiliate Program that may be established and amended by us in our discretion from time to time.

6. LIABILITY. Shall not be responsible for any direct or indirect damages or liabilities of any nature, including but not limited to incidental, consequential, indirect, or special damages, lost business opportunity or any other damages. Ezywebhosting will not be liable for indirect or accidental loss of revenue or commissions due to affiliate tracking failures, loss of database files, and any results of "intent of harm" to the program. We make no claim that the operation of Ezywebhosting will be error-free and will not be liable for any interruptions or errors.

7. TERMS OF THE AGREEMENT. These terms will begin upon your signup with the affiliate program and will end when either you or Ezywebhosting terminates your affiliate status. The terms of this agreement may be modified at any time by Ezywebhosting. If any modification is unacceptable to you, your only choice is to terminate your affiliate status. Your continuing participation in the program will constitute your acceptance of any change.

We will be responsible for handling all customer inquiries, product orders, customer billing and collection, product shipment relative to customers that enter our site through the links from your site. Pricing of our products and services is totally within our discretion and we reserve the right to change the pricing structure, terminate any special offers, discontinue products or services, or change the terms under which products or services are offered at any time, without any advanced notice to you or users accessing our site. Our only responsibility to you in this regard is to track customer orders that occur through links from your web site and make reports to you of the commissions due to you as a result thereof.

BY CLICKING THE ACCEPTANCE BUTTON, YOU REPRESENT AND WARRANT TO US THAT YOU HAVE CAREFULLY REVIEWED THE TERMS AND CONDITIONS SET FORTH IN THIS AGREEMENT AND THAT YOU AGREE TO BE BOUND BY ALL SUCH TERMS AND CONDITIONS.
